1. Purpose and scope

This legal notice governs access to, browsing and use of the website konai.es (hereinafter, “the website”), as well as the responsibilities arising from the use of its content. Its owner is Koldo Asueta Etxegibel y Otro, C.B.(hereinafter, “Konai” or “the owner”), whose identification details are set out insection 10. References to “we” or “us” refer to the owner.

Accessing the website makes you a user and implies full acceptance of the terms in this legal notice, in the version published at the time of access. If you do not agree with them, you must refrain from using the website.

The website is informative: it presents the owner’s services and offers ways to get in touch. Any service is contracted outside the website, by means of an express proposal and acceptance between the parties.

Access to the website is free of charge, without prejudice to the cost of the internet connection borne by the user. Use of the contact form and of the phone demo is voluntary.

The user undertakes to use the website and its content in accordance with the law, morality, public order, good faith and this legal notice. In particular, the user undertakes not to:

• Send, through the form, email or the phone demo, mass or unsolicited advertising messages, or third-party data without their permission.

The owner may prevent access to or use of the website, or of any of its services, by anyone who breaches these terms.

3. Content and demos

The content of the website is for information purposes and does not constitute a contractual offer. The terms of each service, including its price, are set in the proposal provided by the owner in each case.

The dashboards, conversations, logs and calculations shown as examples contain made-up data and are labelled as such. The calculator’s estimates are for guidance only and do not constitute a commitment to any result.

In the phone demo, calls are answered by an artificial intelligence agent. This is stated at the start of every call. Its answers are for demonstration purposes and do not constitute advice or any commitment on the part of the owner.

4. Intellectual and industrial property

All content on the website (text, graphic design, images, illustrations, mock-ups, source code, brand, trade name and logo) belongs to Koldo Asueta Etxegibel y Otro, C.B. or to third parties who have authorised its use, and is protected by intellectual and industrial property law.

Its reproduction, distribution, public communication, making available or transformation, in whole or in part, is prohibited without the prior written authorisation of the owner, except for the user’s personal and private use or in the cases permitted by law.

Access to the website does not imply any assignment or licence of these rights to the user. Any third-party brands and names that may appear belong to their respective owners.

5. Liability

The owner endeavours to keep the information on the website accurate and up to date, but does not guarantee that it is free of errors or that the content will always meet each user’s specific needs.

To the extent permitted by law, the owner shall not be liable for:

• Interruptions, errors or unavailability of the website due to causes beyond its control, maintenance work or failures of telecommunications networks.

9. Governing law and jurisdiction

This legal notice is governed by Spanish law. Any dispute relating to the website shall be submitted to the courts and tribunals that have jurisdiction under the applicable rules. Where the user is a consumer, the courts of their place of residence shall have jurisdiction.
